Holding a company accountable for carbon offset issues

Consumers increasingly choose what businesses to patronize based on their sense of personal ethics. Concern about environmental impact is a relatively common issue that influences consumer choices.

Consumers often prefer to patronize businesses that have minimal environmental impact or that work to directly reduce the ecological effects of organizational operations. In some industries, it may be possible to control waste and pollution through the use of cutting-edge technology and specialized systems. Other types of businesses naturally produce greenhouse gases, including carbon dioxide (CO₂) emissions.

One of the methods businesses have used to reduce their environmental impact and appeal to modern consumers is to purchase carbon offsets. Unfortunately, some of the companies offering carbon offsets have not fulfilled their contractual promises to their clients. Businesses may need to pursue litigation to hold carbon offset companies accountable for scamming them and potentially damaging their reputations.

Carbon offsets have dropped in credibility

Carbon offsets have long been a tool used by businesses with outsized environmental impact. In recent years, there have been numerous large scandals involving companies providing carbon offsets. Some of the biggest companies in the world have ended up implicated in carbon offset scandals because carbon offset companies do not fulfill their end of the agreement.

In some cases, there have even been federal criminal charges filed because of carbon offset fraud. There have also been several lawsuits filed against companies that did not have the right to sell carbon offsets or otherwise engaged in fraudulent business practices.

Not only do those organizations have to consider the financial investment that they made in what was ultimately not a valuable contract, but they also have to consider the reputation damage that a carbon offset controversy could generate. Consumers online could quickly connect a business to a questionable carbon offset brand.

Those consumers may then choose to go with a different company for the goods or services they hope to acquire. They may also spread the story about the purported greenwashing, which is an attempt to appear more environmentally-friendly without making necessary changes. The more a company has invested in carbon offsets and the more egregious the violations of the company provided those offsets, the more important it may be to take the matter to civil court.

Successful business litigation might result in financial compensation for both the amount spent on ineffective carbon offsets and damages related to the reputation damage caused by the offset issue.
